S&H Attorneys Tamir Goldstein & Jessica Arett Secure Victory in Confidentiality Agreement Case for Prominent Denver Law Firm

DENVER (Dec. 15, 2022) – Sherman & Howard attorneys Tamir Goldstein and Jessica Arett helped secure a victory for Franklin D Azar & Associates convincing a jury that a former attorney at Azar’s firm breached her employment and confidentiality agreements when she left the firm.

The jury also rejected the defendant’s counterclaims of defamation in which she sought millions of dollars in damages.

Azar told Law 360: “I think this is one of the biggest victories of my life because they attacked me personally, and they said a lot of things about myself and my law firm and the employees who work for me, and they’ve all been vindicated.”

The Law 360 article reported that Azar’s team of attorneys depicted the attorney as someone who was trying to get a better job in a major firm, “and came up with this plan to steal away the firm’s class action department.”

Goldstein was quoted in closing arguments saying, “She didn’t have a partnership, she didn’t have prestige, and she wanted more money. She was free to leave and go get another job. What she was not free to do was violate the contract.”

According to Law 360, Goldstein in closing arguments told the jury that the attorney tried to solicit Azar’s class action department to leave with her “by first telling them that Azar planned to shutter the department and fire them,” and later with a Power Point presentation in which he said was “a clear inducement and solicitation to employees.”
