What Lies Underneath: A Guide to Differing Site Conditions

Sherman & Howard’s Construction Law Practice Group invites you to attend a complimentary webinar.

Presented by Ryan Klein

Any contractor excavating would enjoy uncovering buried treasure or finding the lost city of El Dorado. Their reality is often the opposite experience with subsurface conditions that are unexpected or vary from the contract documents. Minor varied conditions ultimately can lead to substantial time delays and additional costs to a project. However, not every varied condition is a differing site condition leading to time extensions and additional compensation. In fact, some may result in a contractor losing money on the project, being terminated for default, or becoming involved in litigation.

Continued success in the construction industry depends on a solid understanding of differing site conditions, how to provide contractual notices, and how to obtain relief for additional costs and time delays. Quick action is required when facing differing site conditions.

This webinar will discuss the following:

  • The differences between Type I and Type II differing site conditions.
  • Methods to determine if a varied condition is a differing site condition.
  • Typical contract and subcontract provisions regarding differing site conditions.
  • Notice required for differing site conditions and the result of not giving notice.
  • How to seek relief for additional costs and time delays resulting from differing site conditions.
  • Best practices associated with differing site conditions.
