Patrick Scully Quoted in Law Week Colorado on Proposed Changes to NLRB Election Rules

Law Week Colorado quoted Sherman & Howard attorney, Patrick Scully, a member of the firm’s Labor & Employment Group. The article, “NLRB Floats New Election Rules” discusses the recently proposed rules from The National Labor Relations Board saying it will “protect employee free choice” regarding union representation. If passed, the new proposal will remove unions’ ability to file “blocking charges” in an effort to postpone a union decertification election.

Patrick explained that in almost every one of his matters where a decertification petition was filed, the union filed charges causing the vote to be postponed and in some cases fizzled out altogether. He also noted that employers are anticipating the NLRB’s joint employer rule to be finalized, as well as a new rule to determine how employers can restrict workers from using company property for personal purposes.
