Law Week Colorado Quotes Patrick Scully in Article Regarding Proposed Bill Tightening Up NLRB Joint Employer Standards

August 8, 2017 – Law Week Colorado interviewed Sherman & Howard’s Labor Law attorney Patrick Scully for comment in the article “Congress Takes Shot at Browning-Ferris.”

In July a bill was proposed putting restrictions on the NLRA and FLSA definition of joint employer. This proposed bill, the “Save Local Business Act,” will narrow the definition of a joint employer to an entity that only has direct control over employment terms and conditions, which directly counters the NLRB’s landmark 2015 decision in Browning-Ferris Industries.  

If passed, the bill would give many employers the clarity they want on Browning-Ferris – which he considers an “inept” decision by the NLRB that shouldn’t have occurred, said Patrick Scully.
