Law Week Colorado Quotes Pat Miller and Nate Whitney Addressing OSHA and Employment Law Issues in Construction

The OSHA topic presented by Pat will focus on developments in the agency since Trump became President.  Pat will address two controversial regulations the new agency head may take action on: September’s crystalline silica exposure limit for construction and the upcoming electronic submission of injury and illness reports.  “Just kind of muddling through the holding pattern we’re in until we get a new head of OSHA has made a lot of employers nervous, just because they really don’t know what’s going to happen,” said Pat.

Nate will present on how an employer can protect themselves with independent contractor agreements and how to distinguish an independent contractor from an employee. “People in construction industries may very well see themselves the targets of audits on a more frequent basis,” said Nate. “Properly distinguishing between independent contractors and employees is crucial” because companies could become subject to back taxes and penalties.
