Law Week Colorado Publishes Key to Light Duty Accommodation Policies is to Not Make Exceptions

Law Week Colorado recently published Brooke Colaizzi’s article “Key to Light Duty Accommodation Policies is to Not Make Exceptions.” The article reviewed the complaint a pregnant employee brought against Walmart for not allowing her to perform light-duty work when injured employees were given accommodations.

The Seventh Circuit Court of Appeals held that Walmart did not violate the woman’s rights. The court agreed with the defense’s argument that having a light-duty policy for employees injured on the job did not automatically extend to pregnant employees. However, the ruling left some questions about an employer’s obligation in such situations.
