Timothy Burr maintains a practice focusing in the area of real estate law, mediation and arbitration. Tim has represented buyers, sellers, developers, investors, lenders and business owners in a wide variety of real estate, financing and commercial transactions, and in the development and leasing of wireless communication sites throughout Arizona and the southwest. He is the author of an Arizona Supreme Court petition resulting in the adoption of an admission-on-motion rule for Arizona.

Representative Matters

Represented real estate and business clients in a wide range of engagements including:

    • buyers and sellers in the transfers of improved commercial office, retail, industrial and multi-family projects;
    • buyers and sellers in the transfers of vacant land from small parcels to the acquisition of a 22,000 acre ranch;
    • landlords and tenants in negotiating and drafting commercial and residential leases;
    • buyers and sellers in construction, purchase and sale of luxury homes;
    • borrowers and lenders for loan transactions, including review of title and survey and drafting of promissory notes, deeds of trust, and other loan documents;
    • counseled home owner’s associations on all aspects of the law pertaining to community associations, including: drafting, amending and interpreting declarations of covenants, conditions and restrictions, articles of incorporation, bylaws, rules and regulations, architectural guidelines and other governing documents; covenant and rule enforcement; insurance related claims; and a host of other legal issues;
    • homebuilders in the acquisition of residential subdivisions; and
    • in the development and leasing of wireless communication sites throughout Arizona and the southwest.

Represented clients as a mediator, arbitrator, and mediation advocate, including:

    • served as a court appointed arbitrator and mediator in numerous cases;
    • served as a member of the American Arbitration Association Commercial Mediation and Commercial Arbitration Panels;
    • served as a mediator for the Arizona Association of Realtors;
    • served as an arbitrator on the State Bar of Arizona legal fee arbitration panel; and
    • served as a mediator for the Office of the Arizona Attorney General.
