Matthew Morrison is a Member in Sherman & Howard’s Labor and Employment Department. His experience covers a wide array of labor and employment issues. He represents employers in federal and state courts in cases arising under Title VII, the FLSA, the ADA, and other employment statutes.  He also arbitrates labor disputes and defends employers against charges filed with the National Labor Relations Board.  In addition, Matthew represents employers before the federal Occupational Safety and Health Review Commission and state-plan occupational safety and health boards, and he advises employers on occupational safety and health compliance, OSHA inspections and citations, and the development of safety and health programs.

Representative Matters
  • Represents employers in state and federal courts and before administrative agencies in cases arising under Title VII, the ADA, the FLSA and other employment statutes
    • Achieved a complete defense verdict in a three-week jury trial in a case brought by the EEOC and multiple plaintiffs, who asserted claims of religious discrimination, retaliation, and denial of religious accommodations (EEOC v. JetStream Ground Services, Inc., Case No. 13-CV-02340 (D. Colo. 2016)).
    • Obtained summary judgment in numerous cases alleging violations of the FLSA, the ADA, and Title VII, including in both single-plaintiff cases and putative class or collective action cases.
    • Won appeal to the Colorado Supreme Court in case alleging misclassification of employees, resulting in favorable interpretation of Colorado’s independent contractor statute (Western Logistics, Inc. v. Industrial Claim Appeals Office, 325 P.3d 550 (Colo. 2014)).
  • Successfully arbitrated labor disputes alleging that employer violated collective bargaining agreements.
  • Defended numerous citations before the federal Occupational Safety and Health Review Commission and state-plan occupational safety and health boards
  • Provides advice to employers on various employment issues, including:
    • Issues relating to Title VII, the FLSA, the ADA, and other statutes
    • Independent contractor/employee classification
    • Occupational safety and health compliance
    • OSHA inspections
    • Development of safety and health programs and policies
