Kirsten Stewart is a Member of Sherman & Howard’s Employee Benefits group. Kirsten provides day-to-day advice to all sizes and types of employers on all aspects of employee benefits including qualified plans, welfare benefits (including compliance with ERISA, COBRA, HIPAA, and the Affordable Care Act), and executive compensation. She is named in Best Lawyers in America for Employee Benefits law and was named “Lawyer of the Year” for the 2014 edition of Best Lawyers in America for Employee Benefits, Denver, CO.

Representative Matters
  • Provides day-to-day advice to employers, including publicly-traded entities, government employers and non-profit entities regarding employee benefits, including qualified plans, non-qualified plans, and welfare benefit plans.
  •  Assists clients with the design and implementation of employee benefit plans.
  • Advises clients maintaining welfare benefit plans regarding compliance with the Affordable Care Act, ERISA, COBRA, HIPAA, the Internal Revenue Code (including nondiscrimination requirements, cafeteria plan rules, and coordination among health reimbursement accounts, health savings accounts, and medical flexible spending accounts) and Medicare Secondary Payer rules.
  • Advises clients regarding qualification issues in qualified plans and applications to obtain IRS approval of correction of errors.
  • Advises clients regarding participation in multiemployer pension plans (including withdrawal liability, delinquent contributions, and audits).
  • Advises clients regarding employee benefit matters in connection with mergers and acquisitions.
  • Advises clients regarding deferred compensation arrangements subject to Internal Revenue Code Section 409A.
  • Performs fiduciary compliance audits and administrative audits and reviews of employee benefit plans.
