Jerome “Jay” Sturhahn, a member of the Litigation, Trials & Appeals practice group, regularly represents clients in federal and state courts throughout the United States and internationally. He handles a wide variety of matters for businesses, foundations, and private individuals, assisting them with the formation and execution of legal strategies, whether in the context of trial, risk mitigation, or settlement. He represents clients in matters involving corporate governance, insurance recovery, contractual disputes, construction law, and securities litigation, and has also guided clients through internal investigations.

Jay’s clients include the largest electricity generation and transmission cooperative in the western United States. He represents the cooperative in all manner of complex commercial disputes.

Before joining Sherman & Howard, Jay clerked for the Honorable James L. Ryan of the U.S. Court of Appeals for the Sixth Circuit and was an attorney at Winston & Strawn in Chicago.


  • Successfully defended an electric utility in a series of highly publicized trials arising from private and government claims for negligence, strict liability, and inverse condemnation following the second-largest wildfire recorded in the State of New Mexico.
  • Obtained more than $100 million in insurance proceeds for individual and corporate clients in high-stakes insurance coverage and bad faith disputes under all manner of insurance policies, including commercial general liability, professional liability, property, pollution legal liability, D&O, EPLI, crime, and others.
  • Conducted special committee and other corporate investigations for public and private companies.
  • Secured a multimillion-dollar recovery of insurance proceeds, plus attorneys’ fees, for a client remediating pollution at the former Lowry Air Force base in a dispute concerning payment under a finite risk insurance policy.
  • Obtained a multimillion-dollar award for a multinational energy company in an international arbitration demanding that a reinsurer fund legal settlements arising out of a catastrophic accident. Subsequently defended the international arbitration award against a challenge filed in the United States District Court for the District of Vermont, which resulted in a settlement for the client paying it the full arbitration award, interest, and all attorneys’ fees incurred in the defense of the arbitration award.
  • Represented groups of investors in lawsuits against their former law firms that had counseled them to invest in land deals related to conservation easements, which were subsequently disallowed by regulatory authorities. Obtained favorable settlements for the investors.
