Jay Sturhahn is a Member in Sherman & Howard’s Litigation Department. Jay represents business and individual policy-holders in disputes with their insurers, including general liability, directors and officers liability, property, builders’ risk, fidelity and surety, employer’s liability, errors and omissions, environmental, commercial auto, health, life, disability, excess/umbrella, crime, cyber risk, reinsurance and captive insurance programs. He also represents clients in general business disputes and litigation, including one of the West’s largest electricity generation and transmission cooperatives. He has represented clients across a variety of industries, including construction, energy, finance, health care, government contracting and others through the United States and internationally. Jay also represents businesses in the construction industry, assisting in claim preparation and defense on matters involving bidding, delays, defective construction or design, differing site conditions, and interference. Jay is a regular author and speaker on insurance coverage and risk avoidance issues impacting business and individuals and was recognized by Colorado Super Lawyers as a “Rising Star” in the areas of Insurance Coverage, Business Litigation and Construction Litigation.

Representative Matters
  • Represents an electricity generation and transmission cooperative (“G&T”) in defense of claims arising from the second largest wildfire in New Mexico history, including claims concerning the G&T’s relationship with its members.
  • Represented client remediating pollution at the former Lowry Air Force base in a lawsuit demanding payment from insurer under a finite risk insurance policy. Resulted in successful recovery of insurance proceeds, at full policy value, plus attorneys’ fees.
  • Obtained a $14 million award for a multinational energy company in an international arbitration demanding a reinsurer fund legal settlements arising out of a catastrophic accident. Subsequently defended the international arbitration award against a challenge filed in the United States District Court, which resulted in a settlement for the client paying it the full arbitration award, interest and all attorneys’ fees incurred in the defense of the arbitration award.
  • Has successfully recovered insurance benefits in lawsuits against D&O insurers for coverage of defense costs and indemnity for judgment against clients.
  • Represented groups of investors in lawsuits against their former law firms that had counseled them to invest in land deals related to conservation easements, which were subsequently disallowed by regulatory authorities. Obtained successful settlements for investors.
  • Regularly represents general contractors seeking insurance coverage for construction defect claims, obtaining millions in indemnity coverage from insurers, while also securing defense for clients from insurers.
  • Represented a medical practice in its claims that its design-builder failed to account for expansive soils, leading to favorable settlement for cost of repair. Pursued the general contractor’s assigned claims against its insurance carrier, resulting in additional negotiated settlements for the client.
  • Successfully prosecuted claims through arbitration on behalf of a general contractor, resulting in an award against the owner for wrongful termination.
