Law Week Colorado Quotes John Doran in Article Regarding Dallas Cowboys’ Ezekiel Elliott’s Labor Dispute

October 23, 2017 – Law Week Colorado quoted Sherman & Howard’s Labor & Employment attorney John Alan Doran in the article “Ezekiel Elliott Suspension Challenge Creates Questions Surrounding Arbitration.”

The NFL Players Association (NFLPA), on behalf of Dallas Cowboys’ running back Ezekiel Elliott, continued the lawsuit battle against the NFL by appealing an unfavorable ruling in support of the NFL to the Southern District Court of New York. With a new judge, Elliott was granted a temporary retraining order demanding that the NFL show cause, delaying the suspension and allowing Elliott back out on the field.

According to John the resulting back and forth fighting in the courts has had a negative effect on the arbitration process in such matters. “Arbitration is supposed to be a quick, reliable and all-but final way to resolve disputes under a collective bargaining agreement,” said John. He continues, “At its worst, this decision necessarily stands for the proposition that every proposed player suspension would cause a player ‘irreparable harm’ and permit any player under suspension to game the system by running to court.”
