Kellie Nelson Fetter is a leader of diverse, caring humans seeking justice through the law.

As a commercial litigator, Kellie represents clients ranging from individual stakeholders in family-held businesses through large international corporations to resolve their disputes in and out of the courtroom. She takes on unique cases and works with a team to craft custom solutions to help her clients achieve their goals efficiently and effectively.

Kellie serves clients in the healthcare, oil and gas, and aerospace industries. Her areas of experience include intellectual property, insurance recovery, e-Discovery, and international arbitration.

She also serves as chair of the firm’s DE&I Task Force.

Experience

COMMERCIAL LITIGATION

  • Recovered more than $3 million in jury verdict and attorneys’ fee award following a 10-day trial in a construction completion and financing dispute.
  • Obtained a favorable settlement on behalf of a radiology practice in arbitration with a revenue cycle management company in a breach of contract and professional negligence action.
  • Negotiated favorable interest swap in lieu of damages in a North Dakota-based oil and gas dispute.
  • Obtained judgment in the clients’ favor following three unrelated Colorado bench trials.

INSURANCE RECOVERY

  • Worked on a team to obtain a $10 million settlement for a policyholder in hotly contested insurance coverage dispute.
  • Obtained defense settlement of $0 out-of-pocket payment for a former director of a gas company in a Montana securities fraud class action seeking more than $11 million.
  • Obtained settlement for full policy limits with minimal out-of-pocket contribution on behalf of architecture and design client.
  • Represented aerospace company in federal court coverage dispute.

INTELLECTUAL PROPERTY

  • Obtained injunctive relief for a patent holder in federal trademark and trade practices litigation.
  • Obtained favorable settlement on behalf of tech start-up in multi-venue trade secret litigation.
  • Represented client in 10-day jury trial regarding Lanham Act violations.

E-DISCOVERY

  • Served as lead attorney for Sherman & Howard’s search and selection of e-Discovery vendors and tools.
  • Used e-discovery tools to design and oversee more efficient processes for transactional document reviews.
  • Coordinated a team of 18 to perform substantive review and analysis of more than 60,000 documents in two weeks.
  • Coordinated service and return of more than 200 Colorado records subpoenas as local discovery counsel for national insurance company in subprime mortgage litigation.
  • Counseled numerous clients in crafting and submitting efficient and cost-effective discovery and subpoena responses using e-Discovery tools.

INTERNATIONAL

  • Achieved a favorable settlement for a client in a London-based arbitration under the UNCITRAL Arbitration Rules.
  • Favorably settled a consulting agreement dispute regarding an oil and gas interest in Kurdistan, Iraq.
  • Obtained deposition subpoenas for witnesses in three foreign countries in an international dispute.

AEROSPACE

  • Represents aerospace company in federal court case involving insurance coverage and the Commercial Space Launch Act.
  • Represents satellite company in rideshare dispute.
